TERMS OF SERVICE
YOGA RETREATS TERMS AND CONDITIONS
Please take time to read and understand the Terms & Conditions detailed below prior to booking a trip with The Glowin’ Retreat. If you decide to book a trip with The Glowin’ Retreat, then you will be required to confirm your agreement to these Terms& Conditions as part of the online booking process.
1. Booking
(a) When you (sometimes referred to as a “traveller” or a “client”) book a trip with The Glowin’ Retreat (sometimes referred to as “we” or “us”), you will be deemed to have agreed to these Terms and Conditions and the details regarding the trip for your chosen destination as listed on our website (collectively, the “Agreement”) will constitute a legally binding contract between you and us. Please note: if you book a trip for multiple people travelling together, then all travellers in that booking will be deemed to have read and agreed to the Terms & Conditions, and to be parties to this Agreement.
(b) Your booking is not considered definite and no contract will exist until we receive a deposit from you and you agree to these terms and conditions.
2. Payment
(a) The price is the exact amount to be received by us per person in EUR.
(b) For retreats, we require a 600€ deposit in order to secure your space. Deposits are non-refundable and non-transferable. There are no exceptions to this policy, for any reason. Please consider your circumstances well before placing your deposit. It is your responsibility to ensure you can attend the retreat before placing your deposit. If your booking is made within 60 days of the trip start date, then the full amount is payable at the time of booking.
(c) You may make additional top up payments through our booking system on your own accord.
(d) Remainder payments are due 60 days prior to start date and are non-transferable and non-refundable. There are no exceptions to this policy, ever. If we do not receive your remainder payment 60 days prior to the start of your program, we reserve the right to open your reservation to another attendee.
3. Roommate Matching
If you are travelling alone, but do not want to pay the higher price for “single occupancy,” then you should notify us at the time of booking. We will do our best to match solo travellers with a roommate of the same gender in order to accommodate the request for the lower “double occupancy” rate. The Glowin’ Retreat makes no promise or guarantee that we can match you with a roommate (for the double occupancy rate) on any given trip.
4. Your Travel Arrangements
(a) All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are not included within the payment within the payment of the retreat.
5. Optional Activities
(a) Optional activities (other than excursions which are listed on our website as “Included”) are not included in the trip price, and do not form part of the trip or this Agreement. You acknowledge and agree that any assistance provided by any trip leader, yoga instructor or local representative in arranging optional activities dos not render us liable for them.
6. Cancellation
(a) It is your responsibility to read and understand our cancellation policy before making a reservation. Naturally, no one books with the intention of cancelling or postponing their retreat, but unexpected things do happen that can be beyond our control. We strongly recommend that you purchase travel cancellation insurance to cover any possible loss.
(b) You (or any member of your party) may cancel your booking at any time, providing that the cancellation is made by the person submitting the booking form and is notified to us in writing. Cancellation will take effect the day such notification is received by us.
(c) For cancellation requests submitted with more than 90 days of the retreat date: 100% of the total amount (less deposit) will be refunded. For cancellation requests submitted within 90 days of the retreat date, 50% of total amount (less deposit) will be refunded. Cancellation requests within 60 days of the retreat: no refunds given, no exceptions.
(d) Bookings are for the stated period of the retreat. There are no refunds for any unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your insurance.
(e) If you fail to show up, or if you leave a trip prior to its completion for any reason, then you will not be entitled to any refund. Bookings for all trips are non-transferable.
7. Travel/Cancellation Insurance
(a) Travel/cancellation insurance is highly recommended. If you choose to buy insurance, we require that your travel insurance covers the activity of this retreat as well as unexpected cancellation, sickness, losses and all the usual risks. You should bring the policy with you in case of an emergency.
(b) We strongly recommend that you purchase travel cancellation insurance to cover any possible loss. Depending on the policy and conditions, travel cancellation insurance will pay for some or all cancellation fees. With most agencies, insurance must be purchased within 14 days of making your reservation.
8. Your Health and Assumption of Risk
(a) It is your responsibility to let your Yoga Instructor know if you have any injuries and to be mindful at all times of your own body’s capability during the retreat. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.
(b) It is also your responsibility to consult a doctor with an understanding of yoga to check that you are sufficiently fit and healthy to undertake yoga classes and other physical activities that you may choose to do whilst on the retreat.
(c) Please advise us on any mental or physical health conditions before you book. If you have health requirements that may be affected by the activities offered on our retreats, we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your stay at our retreats.
(d) We will send you a dietary questionnaire when you book where you must inform us of any dietary requirements that you have. If you have dietary requirements that may be affected by the activities offered on our retreats, we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your stay at our retreats.
(e) Whilst all measures are taken to ensure a high standard of health and safety, our retreats are situated in countryside locations where the land is uneven, sometimes on farms, with animals and insects, and we shall not be responsible for any injuries caused.
(f) Women who are 12 to 28 weeks pregnant should provide a letter from their health practitioner specifying that they are fit to travel and able to engage in the activities that we provide. We would prefer pregnant women to have done a little yoga before they arrive.
(g) You agree to any mandatory health rules and declarations on arrival to our retreats including body temperatures taken prior to entering our retreats, wearing face masks and whatever the local rules restrictions are currently abiding by.
(h) The Glowin’ Retreat is dedicated to providing a safe environment for all clients who participate on our trips. However, you must take full responsibility for your own behaviour and safety. Furthermore, you understand and assume the risks and hazards inherent in travel. These risks and hazards may include, without limitation, delays, injury, illness, death or other anticipated events, and may be caused by force majeure events, the accidental negligence of The Glowin’ Retreat or other persons (including third party operators), the intentional and/or criminal conduct of others or other circumstances. Certain locations are remote and require additional travel time away from city centres and towns; as such, medical attentions may not always be readily available or may be inferior quality compared to what is available at home. Also, you may be visiting places where the political, cultural and geographical environment is very different than to where you live, and in some cases, these differences may present increased risks and/or challenges. We use reasonably available information, applicable foreign governments and reports from our contacts in planning each trip itinerary, and assessing the viability of each trip itinerary as the start date approaches. However, it is your responsibility to acquaint yourself with all available and relevant travel information for your destination and the nature of your itinerary. You acknowledge and agree that your destination to travel is made after having considered this information and you expressly assume the personal risks involved with such travel.
9. Covid-19/ Force Majeure
(a) There is no cancellation refund for any reason including but not limited to natural disasters, acts of terrorism, pandemics, illness, health conditions, medical or personal or family or work emergencies, or change of mind.
(b) If you cannot reach the retreat or training due to unforeseen circumstances of any reason, including but not limited to strikes, travel bans, weather circumstances, and missed, delayed, or cancelled flights, retreat fees are unfortunately non-refundable and non-transferable. We strongly recommend purchasing travel cancellation insurance.
10. Complaints
(a) If you have a problem during your retreat, please inform the organiser immediately and they will endeavour to put things right. Please note that we cannot be responsible for the individual behaviour of any group member or other guest sharing your accommodation.
(b) We reserve the right to remove a participant from the program if their behaviour is disruptive. In the event of such dismissal, no refunds will be made for travel, meal or accommodation packages booked.
11. Amendments by us
(a) Occasionally, changes may have to be made (e.g., yoga teacher, class times, covid restrictions or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.
(b) The itinerary listed for each trip represents a general plan for that trip (including the day-by-day schedule of activities). However, you acknowledge and accept that circumstances may arise which result in changes to the listed itinerary. These changes may include, without limitation, delays and/or partial or complete changes in the following: the itinerary, trip leaders/yoga teachers, frequency of yoga sessions, quality or location of lodging, modes or quality of transportation, etc. You understand and agree that: (i) The Glowin’ Retreat and/or its designees may make last-minute or on-site decisions to address changed circumstances, (ii) The Glowin’ Retreat does not guarantee conformity with any itineraries that have been published or furnished to you or any other clients, and (iii) The Glowin’ Retreat reserves the right to change the itinerary with or without notice to you. Furthermore, all yoga instruction/classes will be provided in the manner determined by each individual yoga instructor in his/her discretion, and will follow that instructor’s individual style. Modifications will be offered as a way of accommodating your level of fitness and physical challenges.
12. Our liability to you
(a) The Glowin’ Retreat does not own, operate or control any person or entity that provides any goods or services for your trip (“Third Party Operators”) including any lodging facilities, airline, ground or water transportation, yoga studio, yoga instructor(s), tour operator, food service provider, etc. Rather, we contract with Third Party Operators to provide all goods and services for your trip; and you understand that all Third-Party Operators are independent contractor(s), and not affiliates or employees of The Glowin’ Retreat. In selecting Third Party Operators, we do our best to seek our reliable suppliers and contractors to provide necessary travel-related goods and services. Accordingly, in the absence of gross negligence by The Glowin’ Retreat, you understand and agree that The Glowin’ Retreat shall not have any responsibility or liability for any acts or omissions of any Third-Party Operators in connection with your trip. Without limiting the foregoing, we will not be liable for any direct, indirect, consequential or incidental damage, liability, injury, loss cost or expense you may incur (including any claim relating to personal injury, illness, death, property damage or loss, delay or other inconvenience) arising out of or by reason of the acts or omissions of any Third-Party Operator.
(b) We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.
(c) In the event of circumstances beyond The Glowin’ Retreat reasonable control e.g. (but not limited to) fire, flood, exceptional weather conditions, loss of electricity/internet connection, disease outbreaks, industrial disputes etc. The Glowin’ Retreat shall not be liable for any resulting costs, losses or damages suffered by you (including the cost of securing alternative accommodation), nor its failure to undertake its obligations to you.
(d) We are not liable for any injuries you may incur. Yoga classes are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.
(e) You acknowledge and agree that The Glowin’ Retreat and its parent, affiliates, subsidiaries, officers, directors, shareholders, members, employees, successors and assigns (collectively, the “TGR Parties”) shall not be liable for any direct, indirect, consequential or incidental damage, liability, injury, loss, cost or expense you may incur (including any claim relating to personal injury, illness, death, property damage or loss, delay or other inconvenience) arising out of or by reason (i) the acts of omissions of any Third Party Operator or (ii) the negligence of any of the TGR Parties or (iii) any acts or omissions of any other parties or (iv) force majeure events. You release the TGR Parties from any and all claims, liabilities, losses, expenses, damages, demands, actions, causes of action, lawsuits or sums of money of any kind arising out of, by reason of, resulting from and/or related to any trip you may book and/or participate in; and you understand and acknowledge that you are fully responsible for and expressly assume any and all risks, whether known or unknown, in connection therewith.
(f) The Glowin’ Retreat cannot be held responsible for injury as a result of failing to adhere to the rules applied surrounding safe use of the premises in which you retreat, of which you will be made aware of upon the day of arrival at the retreat location.
13. Group Bookings
(a) Where a booking is made on behalf of several individuals, the booking is conditional on the person(s) paying having authorization from all the individuals named on the booking form to enter into this contract. The terms of this contact will apply to each member of the group as though they had paid for their own retreat individually and directly to us.
14. No liability for possessions
(a) It is your responsibility to ensure that your possessions are kept safe at all times. This includes hire cars or other hired equipment.
(b) Any valuables left at the property in which you retreat are left at your own risk. The Glowin’ Retreat are not responsible for any loss. Proper care must be taken against theft and burglary. No refund will be given should you decide to vacate the property as a consequence of burglary. The Glowin’ Retreat does not accept any liability in relation to loss and damage to your belongings as a result of your stay.
15. Photography and Videography
(a) You, for good and valuable consideration, hereby irrevocably authorise The Glowin’ Retreat to use photographs and videos of you and/or your property and authorise THE GLOWIN’ RETREAT and its assignees, licensees, legal representatives and transferees to use and publish (with or without your name) photographs, pictures, portraits, videos or images in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by the photographer or The Glowin’ Retreat. You further waive any and all rights to review or approve any uses of the images, any written copy or finished product.
16. Updating of Terms & Conditions
(a) The Glowin’ Retreat reserves the right to update and/or alter these Terms & Conditions at any time. Current information can always be found on www.theglowinretreat.com and any updates and/or changes will supersede any previous versions. By booking a trip with The Glowin’ Retreat, you acknowledge that you have read and understand the Terms & Conditions outlined above, and agree to be bound by those Terms & Conditions.
You are of full legal age and have read and fully understand the terms of this release.
